Lindsay Clancy wants appeal court to force trial judge to boot holdout juror or question him

Lindsay Clancy is asking Massachusetts’ highest court to force the judge overseeing her high-profile triple murder trial to individually question or boot the holdout juror in her case before a mistrial is declared.Clancy’s lawyers filed emergency papers with the Massachusetts Supreme Judicial Court Friday afternoon to block Judge William Sullivan from declaring a mistrial on the grounds that he made a bad call when he chose not to probe a male holdout juror who allegedly didn’t follow the law on reasonable doubt.Follow The Post’s live updates on the Lindsay Clancy trialEarlier Friday, Reddington pleaded with Sullivan to query the juror but Sullivan denied the request after he questioned the panelists Thursday asking each of them one by one if they could follow his law.

Sullivan then re-read his jury instructions on reasonable doubt to the jury.“A mistrial at this point is entirely avoidable, but only if the court does its job,” read Clancy’s appeal papers, filed by her lawyer, Dana Goldblatt.Clancy specifically wants the appeal court judge to ask about the juror’s ability “to apply the law” and stop him from any more deliberations “until the court determines … the juror is willing and able to follow the court’s instructions.”“Intervention is necessary in this case to avoid an avoidable mistrial of a case that is so time and labor intensive and that has captured so much public attention,” the papers said.“It is also necessary to preserve the defendant’s right to a fair trial by unbiased jurors applying the law.”The 12-person jury — composed of nine women and three men — deliberated for over 38 hours for more than a week before Sullivan was prepared to declare a mistrial Friday after receiving its third deadlock note.The group was deciding whether to convict the 36-year-old Duxbury mom of first-degree murder for strangling her three kids, Cora, 5, Dawson, 3 and Callan, 8 months, on Jan.
